Welcome to SimpleSplit. These Terms of Service ("Terms") govern your use of the SimpleSplit mobile application (the "App") operated by SimpleSplit ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

Description of Service

SimpleSplit is a mobile fitness application that allows users to:

• Create custom workout days and exercises
• Build workout splits (weekly or rotation-based schedules)
• Schedule and track workouts
• Log sets, reps, weights, and bodyweight
• View progress through charts and workout history
• Sync data across devices
• Export workout data

Account Terms

Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account
• Maintain only one account per person

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to hack, reverse engineer, or compromise the App's security
• Interfere with or disrupt the App or its servers
• Share your account credentials with others
• Create multiple accounts
• Use automated systems or bots to access the App
• Abuse, harass, or interfere with other users
• Attempt to access data belonging to other users

Intellectual Property

Our Property

The App, including its design, features, code, graphics, and branding, is owned by SimpleSplit and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

Your Content

You retain ownership of the workout data and content you create in the App. By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing and improving the App's services to you.

Pricing

SimpleSplit is currently free to use. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will notify you in advance and any new pricing will only apply to features or services you choose to purchase.

Disclaimers

Fitness Disclaimer

SimpleSplit is a workout tracking tool, not a fitness advisor. The App does not provide medical, health, or fitness advice. You should consult with a qualified healthcare provider or fitness professional before starting any exercise program. You use the App and perform any exercises at your own risk. SimpleSplit is not responsible for any injuries or health issues that may result from your workouts.

Service Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Data Disclaimer

While we take reasonable precautions to protect your data, we cannot guarantee against data loss. We recommend regularly exporting your data using the App's export feature.

Limitation of Liability

To the maximum extent permitted by law, SimpleSplit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising out of or related to your use of the App. Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless SimpleSplit from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another party.

Termination

We may suspend or terminate your account at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination:

• Your right to use the App will immediately cease
• You may export your data before termination if possible
• We may delete your data after a reasonable period

Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Massachusetts.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SimpleSplit regarding your use of the App and supersede any prior agreements.
